A tragic incident in Dublin has left a man dead after his partner allegedly assaulted him, resulting in a fatal fractured skull. Charges have been filed against the woman, who appeared in court facing serious harm allegations.

The victim, James (Shey) Ryan, 61, was found outside his home in north County Dublin with serious injuries. He was rushed to Beaumont Hospital but unfortunately succumbed to his injuries the following day. Mr. Ryan, a grandad and father-of-four, was formerly from Shelmalier Road in Dublin’s East Wall. He was also a former member of the Defence Forces and had been battling Parkinson’s Disease.

The accused, Olesja Hertova, 48, appeared before Judge Monika Leech at Dublin District Court on charges of causing serious harm to Mr. Ryan. The incident occurred on August 10 at their home in Hastings Lawn, Balbriggan. Hertova was remanded in custody with consent to bail on a bond of €5k and an independent surety of €10k, despite objections from the authorities.

Detective Garda Stephen Hughes of Balbriggan Garda Station provided evidence of the arrest, charge, and caution of the accused. He mentioned that the investigation is ongoing, and further charges may be contemplated based on the evidence gathered. It is alleged that Hertova pushed Mr. Ryan to the floor, resulting in the fatal injury that led to his death.

Despite objections from the police regarding bail, Judge Leech granted Hertova bail under strict conditions. She is to have no contact with any witnesses, obey a curfew, sign in regularly at a designated garda station, and not leave her home without notifying the authorities. Hertova is scheduled to appear in court again via videolink on September 4.

Domestic Violence and Its Impact

This decision reflects the principles of the legal system, which aims to balance the rights of the accused with the need for justice and protection of the community.

The bail conditions imposed on Hertova are designed to ensure that she complies with the law and does not pose a threat to witnesses or the public. By requiring her to adhere to a curfew, sign in regularly at a police station, and refrain from contacting witnesses, the court is taking proactive steps to prevent any potential harm or interference in the case.
